6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services ("User-Generated Content"). By submitting User-Generated Content, you grant Spicetier a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that such content does not infringe upon the rights of any third party. Spicetier does not endorse any User-Generated Content and disclaims any and all liability for any User-Generated Content. We reserve the right to remove or edit any User-Generated Content at our sole discretion.

By submitting User-Generated Content, you acknowledge that you are solely responsible for such content and any consequences arising from its submission. You agree that Spicetier is not responsible for any loss or damage of any kind incurred as a result of any such content.

7. Payment Terms

Access to certain features of spicetier.info may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable and are due in advance of the service period. You are responsible for providing accurate billing information and for keeping your payment information up to date.

Spicetier reserves the right to change its pricing at any time. In the event that we discontinue the services, we will provide you with a reasonable notice period to allow you to retrieve your data, if applicable. However, we are not responsible for any loss of data resulting from the discontinuation of the services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Spicetier, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall Spicetier’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

The limitations set forth in this section are fundamental elements of the basis of the bargain between you and Spicetier. You agree that these limitations will survive and apply even if any limited remedy specified in these Terms of Service is found to have failed of its essential purpose.

10. Termination

These Terms of Service are effective until terminated by either party. You may terminate these Terms of Service at any time by discontinuing your use of the services and deleting your account. Spicetier may terminate or suspend your access to the services immediately, without prior notice or liability, if you breach these Terms of Service or if we believe that your conduct poses a risk to Spicetier, other users, or any third party.

Upon termination of your account, your right to use the services will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, you are responsible for retrieving any data you wish to retain. Spicetier is not responsible for any loss of data following termination of your account.
